Canada tries again to update copyright legislation (Reuters)

OTTAWA (Reuters) ? Canada will reintroduce copyright legislation on Thursday as it grapples with the realities of the Internet age and tries to balance the demands of consumers with concerns from the movie industry.

The legislation, first introduced ahead of the federal election in May, is designed to cope with things like movie piracy, which the Canadian Motion Picture Distributors Association put at more than C$1.8 billion ($1.7 billion) in 2009-10, or the equivalent of 12,600 full-time jobs.

"In the absence of clear and modern copyright rules, digital piracy caused enormous damage to the creative industries, Canadian jobs and the entire economy," the association said in parliamentary testimony earlier this year.

The legislation would let Canadians copy legally acquired music and movies to their iPods and computers but it would bar most attempts to get around digital locks, which limit access to books, movies, music, video games and electronic devices.

In a concession to consumers, the bill would allow them to circumvent a digital lock on their smart phones to let them switch wireless service providers, if their contract allows that.

Introducing the legislation the first time, the Conservative government found it hard to please both the consumers and educators who want lax rules on copying film, books and music, and the movie industry and the U.S. government which both want tighter rules.

In 2009, with the apparent acquiescence of Ottawa, Washington placed Canada on its "priority watch list" of countries with the worst records of preventing copyright theft.

A Wikileaks cable revealed that the office of then industry minister Tony Clement told a U.S. diplomat that being put on the priority watch list might help the government get copyright legislation through.

By introducing the bill in the same form as before the federal election, the government plans to avoid Parliament calling up groups that have already testified about the legislation.

"That suggests things could move very quickly with a few sessions and a march to passing the bill before the end of 2011," said Michael Geist, copyright expert at the University of Ottawa.

The bill would cut the penalties that companies could seek for most private infringement of copyrights. Statutory damages would be reduced to a one-time payment of between C$100 and C$5,000, compared with the maximum current punishment of C$20,000 for a single offense.

Hungary villages heal slowly from red sludge spill (Reuters)

KOLONTAR, Hungary (Reuters) ? Shortly after noon on a sunny day last October, 56-year-old Janos Fuchs was plowing his field in western Hungary when a nearby reservoir wall collapsed, unleashing a torrent of toxic waste that destroyed all in its path.

Fuchs managed to reach higher ground on his tractor but he could do nothing but watch as the flood of caustic red mud -- the waste from a nearby alumina plant -- swept away his village, ruining his mother's home as well as his own.

She would be found dead three days later, half a mile downstream.

"When I returned to my house, I reached for my keys... only to realize the door was gone," Fuchs said.

The disaster, the worst in Hungarian history, killed 10 people and injured 120, polluted a town and two villages, including Kolontar, bleached nearby rivers and spread 1.9 million cubic meters of a soft sludge, the color of tennis clay, which emitted a pungent acidic smell that could be detected miles away.

The physical cleanup is nearly complete.

Crews have removed 53,000 truckloads of the sludge from the fields. Hundreds of damaged houses have been bulldozed and about a hundred new ones were built for those who requested them. Vegetation and soil have been replaced. Two memorial parks are being erected.

But the emotional scars will take much more time to heal.

Hungarian Aluminum (MAL), the metals company behind the sludge, was under state management for months. Eight of its employees are suspects in an ongoing investigation, and the company has received a 135-billion-forint ($632-million) fine.

MAL, which controls 4 percent of the global alumina market, offered condolences and apologies, but denied wrongdoing and disputes the fine.

Despite the cleanup and the fines, the fierce anger toward MAL's private owners still burns strong.

"These people are billionaires, and they couldn't care less about the rest of us," said Fuchs, who was the first to launch a lawsuit seeking damages. "Enough is enough. Innocent people die while they live happily ever after?!"

MAL declined to answer Reuters questions.

HEALING SLOWLY

Kolontar now has a lopsided look to it. The Catholic church, once in the center of the village, now stands on the very edge, the neighborhood beyond erased from the map.

On a World War II memorial column at the foot of the church hill, a newly carved marble plaque reads: "Remembering the human and natural toll of negligence and greed. 4 October 2010."

Mayor Karoly Tili says things in the village, most of whose 850 residents worked in agriculture or at the alumina plant, are slowly returning to normal. As the cleanup crews wrap up work in the next few months, Kolontar can begin to focus on things that mattered before the sludge rewrote everyone's lives.

"Healing is so complex," Tili said. "Those who lost loved ones will never forget. But those who did not have mostly got past the memories by now. We have had a psychotherapist on the scene for a year. Lots of people have visited her."

He added that the big fine levied on MAL could help, but he did not hold out much hope of collecting it.

"It's just a number. It would be a miracle for MAL to fork out this much, but if the actual damages were recovered, that could at least show that nobody can avoid the consequences of a disaster like this."

Environmental advocates and the government also did not expect the whole fine would end up being paid out, but said the principle was what mattered.

Zoltan Illes, Hungary's state secretary for the environment, did not exclude the possibility the state may eventually take over MAL.

"Even if 100 percent state ownership were introduced, the law must be obeyed," he said.

"The Hungarian government will support all the activities of the company, will stand behind this company, to keep its 6,000 workplaces in that region, and also to keep this alumina processing activity," Illes said.

AN EXPENSIVE LESSON

The Kolontar site is only one of dozens of toxic waste depositories in central Europe, which remain open until they are filled, after which they are covered with soil. Many of the sites are in poor condition and at risk, the environmental activist group Greenpeace has said.

"In general, the government did a good job cleaning up the toxic material that spilled all over the region," Greenpeace campaigner Balazs Tomori said. "But there is no guarantee that a next Kolontar, another toxic waste spill won't happen again."

"The ex-Socialist bloc is full of (toxic waste) deposits, legal and illegal... We'd be happier to see stronger prevention. That is always the cheapest for everyone."

The Hungarian government is aware of the risks, environment secretary Illes said, but even in places where alumina reservoirs are directly on the banks of the Danube, the only truly safe solution -- relocating the waste -- is prohibitively expensive.

Illes said he has proposed to the European Union that the group create a type of Superfund, similar to one managed by the U.S. Environmental Protection Agency, with an initial 5-7 billion euros of EU funds.

Even the area around Kolontar faces further pollution. MAL has switched to another technology which produces dry waste, not the liquid that swept over the landscape. The problem now is flying red dust, which can cause respiratory illnesses.

Jozsef Kovacs, whose house in Devecser town was destroyed by the mud, moved a few km (one mile) further away as soon as he received compensation.

"We left our town because my daughter was pregnant and we thought a little distance would be a good idea. But the wind still blows red from time to time," he said.

"Like in every environmental case, there is no perfect solution," Illes said, adding that the red dust was by far the lesser of two evils.

The residents of Kolontar are happy just to resume a semblance of normality after months spent in rental apartments paid for through donations.

Jozsef Holczer moved into a previously owned home in May, up the hill from the spill which erased his home and his vineyard. Recently retired, he had planned to make wine to augment his pension.

"I was about to press the first batch when that filth came," he said. "But there are grapes in my new yard again, and they are good enough for some wine."

To commemorate the calamity, Holczer decided he would never shave again. He has grown a long white beard in the past year. He walks with a slight limp, and his smile is slow to curve.

"I was twice reborn last year... it is impossible to forget. But go elsewhere? I've never lived anywhere else. Where else would I go?" ($1 = 213.75 Hungarian Forints)

Researchers have found that a species invasion that starts at the upstream edge of its range may have a major advantage over downstream competitors, at least in environments with a strong prevailing direction of water or wind currents.

Scientists from the University of Georgia, University of New Hampshire, Smithsonian Environmental Research Center and University of Vermont studied populations of European green crab, Carcinus maenas. The species was introduced to the East Coast of North America twice, at both the upper and lower edges of its range. Their findings, recently published in the Proceedings of the National Academy of Sciences, may help inform the control of invasive species and the conservation of imperiled native species.

"In New England, they're worried," said Jeb Byers, an associate professor at the UGA Odum School of Ecology and one of the paper's authors. "These green crabs have been doing a number on native shellfish. They eat a lot of clams. And they're a very cosmopolitan species?they've now spread all over, to places as far afield as the West Coast of the U.S. and South Africa."

The European green crab was first detected in North America in New Jersey in the early 1800s, Byers said. It spread slowly north against the prevailing direction of ocean currents until it reached Halifax, Nova Scotia in 1964. That was the extent of its range along the East Coast until the 1990s, when populations suddenly appeared throughout the Canadian Maritime provinces.

Conservation biologist Joe Roman of the University of Vermont, another of the paper's authors, determined that these new populations were genetically different from those established earlier. Analysis revealed that unlike the earlier arrivals, they were related to European green crabs found in the Baltic, suggesting a new introduction directly from Europe to Nova Scotia had taken place.

Understanding how the species spread could offer insights into how to control it.

"Our theory was that the old invasion spread as far as it could upstream before fighting the currents made it impossible to spread farther," Byers said. "We suspected that the new invaders were successful essentially because of physics. Unlike their predecessors, they didn't have to fight their way against the current to spread. They just had to disperse their larvae into the water column and let the current carry them south along the coast."

The second crab invasion established in the Strait of Canso and Bras d'Or Lake in northern Nova Scotia, locations well suited to serve as large population retention zones. These zones anchor the crab population because they are not subject to the strong currents typical of the outer coast.

"If you look at the prevailing ocean currents in the area, you can see that these population retention zones are at the upstream edge of practically the entire distribution of the crabs," Byers said. "Crab larvae enter the water column from there and drift south."

Byers and his colleagues genetically sampled crab populations from New York to northern Nova Scotia from 1999 to 2007. They found that the northern crabs were making up a greater share of the crab population at each sampling site as time progressed. "The northern crabs were 20 percent more common within only a few generations," Byers said.

They also found that areas not previously invaded by southern crabs were susceptible to invasion by northern crabs. "The currents were carrying the crab larvae downstream from the northern populations into areas that the crabs moving under their own power up from the south were unable to colonize," he said.

The team's findings could help target efforts to control invasive species and conserve native species in environments influenced by strong water or air currents.

"Upstream retention zones should hold dominant sway over species and genetic level diversity in environments with strong physical influences," Byers said. "That's where we need to focus our vigilance, because such retention zones are capable of populating entire regions.

"If you're trying to control an invasive species, you'll be more effective if you can attack the source of the population; and if you're trying to conserve a native species, protecting populations in the retention zone will be critical."

UN chief warns discrimination is increasing (AP)

UNITED NATIONS ? Secretary-General Ban Ki-moon warned Thursday that 10 years after a controversial U.N. conference to combat racism, intolerance and discrimination are increasing in many parts of the world.

The U.N. chief urged all countries to "stand firmly" against anti-Semitism and Islamophobia and reject discrimination against Christians. He also called for an end to discrimination based on race, color, language, political opinion, gender or sexual orientation.

The 2001 conference in the South African port city of Durban ended in fierce acrimony amid accusations that it had been hijacked to bash Israel, Zionism and Jews.

The U.N. maintains that confusion between the official gathering in 2001 and a parallel conference of non-governmental organizations "fuels many of the misperceptions about anti-Israel sentiment in relation to the World Conference."

But the language at the official gathering ? walked out of by the U.S. and Israel ? was harsh on the Jewish state. Yasser Arafat, then the Palestinian leader, described Israel as having "a supremacist mentality, a mentality of racial discrimination," while Cuban leader Fidel Castro accused it of perpetrating "genocide against the Palestinian people."

The final communique dropped condemnations of the "racist practices" of Israel and Zionism. And the conference itself quickly faded from public attention when the U.S. was hit with the Sept. 11 terrorist attacks.

At Thursday's high-level U.N. commemoration of the Durban event, the secretary-general said there had been progress over the past decade, including new laws to protect against genocide, apartheid, ethnic cleansing and slavery ? and people's antennae "are better attuned to see the insidious forms of discrimination."

"Yet we must acknolwedge that intolerance has increased in many parts of the world over the past decade," Ban told the General Assembly. "The resurgence and persistence of such inhumane attitudes and detrimental practices indicate that we have not done enough to stem the tide."

The United States, Israel and a dozen other countries announced that they were boycotting Thursday's commemoration.

A competing parallel event was held at a hotel across the street, featuring speakers including former U.S. Ambassador to the United Nations John Bolton, Nobel laureate and Holocaust survivor Elie Wiesel, and Harvard law professor Alan Dershowitz.

"You don't have to be a human rights activist or a Harvard Law professor to understand that the Durban Declaration has been contaminated by the taint of racism that it claims to fight" Israel's U.N. Ambassador Ron Prosor said at the opening of the parallel gathering.

In anticipation of possible outbursts during the official meeting, the secretary-general stressed that its aim was to further the fight against racism and "we should condemn anyone who uses this platform to subvert that effort with inflammatory rhetoric, baselss assertions and hateful speech."

Ban said "the stakes are high" because ignorance and intolerance are among the root causes of conflicts, and racism and discrimination are major obstacles to economic development.

He urged governments to ensure that unemployment and deteriorating living standards aren't used as excuses for attacks on migrants and other vulnerable groups.

Taking aim at political parties preaching xenophobia, Ban said: "We must resist polarizing politicians who play on people's fears and use stereotypes to gain electoral advantage."

Ban's warning of escalating discrimination and intolerance was echoed by General Assembly President Nassir Abdulaziz Al-Nasser who called the continuing scourge of racism and xenophobia "one of the most critical challenges of the 21st century."

"Racist atttitudes and hate speech can be found in many countries and the Internet provides a new vehicle for their proliferation," he said.

Libyan-American recalls horror in Gadhafi prison

After blindfolding Abdulmoneim Tabuni, a prison guard put a gun to his head and told him to "say a prayer."

It was the most harrowing moment of the Libyan-American research scientist's six-month imprisonment in the Libyan capital of Tripoli, as fighting raged across the North African country to oust embattled leader Moammar Gadhafi.

Tabuni, a 55-year-old father of five, suffered other horrors at the hands of Gadhafi's henchmen: He was beaten twice, forced to share a cramped cell with others who took out their anger on him and had to endure the almost daily crackle of gunfire filtering in from outside ? all while being held a short distance from his home.

Despite the horrors, Tabuni ? who lost some 60 to 70 pounds ? is not focused on taking revenge against his captors but on crafting a new future for his homeland.

"We should think about the future not the past," he told msnbc.com in a telephone interview from Tripoli. People should be held accountable if they did killings, beatings or torture, but there should also "be forgiveness and reconciliation."

Tabuni, who returned to his homeland in 2006 to care for his ailing mother, attracted the attention of Gadhafi's security apparatus on Feb. 7 ? 10 days before the first protests erupted. He said he was questioned by national security officers about emails they accused him of sending to encourage people to join the upcoming demonstrations, which Tabuni says he never sent. He was eventually released and allowed to return home ? but not for long.

After violent protests on Feb. 17, security forces arrested his nephew for uploading a photo onto Facebook showing dead demonstrators in the eastern opposition stronghold of Benghazi.

Tabuni went with his nephew to the security center, thinking he would be able to bring him home. Instead, both were arrested.

'Grave cell'
So began Tabuni's odyssey through dark halls and dim cells, first at the national internal security center and later in the notorious Abu Salim prison, where an estimated 1,200 inmates were killed in a 1996 massacre, according to Human Rights Watch.? Among the first participants in the February protests were families who lost loved ones in the prison massacre, Ahmed El-Gasir, of the Libya-focused Human Rights Solidarity organization, said earlier this year .

At the security center, Tabuni lived for three months in what he called a "grave cell" ? a 3-by-6-foot room ? using a water bottle as a pillow. There was no toilet in the cell, and prisoners were only allowed to go to the restroom three times a day, so Tabuni said he hardly touched the food and water he was given in order to avoid having to urinate or defecate in his cell.

Prisoners weren't allowed to talk and could hardly see one another, since little sunlight penetrated the jail. Tabuni, who didn't even know his nephew was being held in a nearby cell, recalled guards beating an older man merely for saying "good morning" to fellow prisoners.

One morning, he was taken out of his cell and blindfolded, then led to an interrogation where a guard put a gun to his head and said: "Say a prayer" three times.

"I said my prayer because I thought ? that was the end of my life," he said. "Those moments, anything can happen to you. I knew, these people, the guards, they can do anything."

Such incidents made Tabuni prefer confinement.

"When they take you out of the cell ? You don't know what is going to happen to you ? they're going to kill you ? beat you, torture you," he said. "Staying inside is the safest place."

His wife, Ghaed Bagegni,? knew he had been detained but, as time passed, didn't know if he was still alive. Ironically, she could see the security center from their home where she sheltered with the couple's youngest son (the other sons and a daughter were in the U.S.).

Tabuni, meanwhile, knew little about what was going on outside ? only what he could glean from newly arrived prisoners.

"You are in a cave. You don't know what's happening outside," he said, noting he didn't believe that NATO had started bombing Libya until he learned such news from a newly arrived prisoner.

The guards moved him to Abu Salim prison on May 14, where three guards beat him ? in what he called a "welcoming reception" ? using electric wire and metal pipes before depositing him in a 6-by-8-foot cell with four to five others. He said there was a bathroom in the cell, but he couldn't wash because they were only given salty water.

"We didn't go outside for exercise," he recalled. "We didn't see the sun."

Tabuni said he was beaten a second time on the face and back a month later during a harsh interrogation, and still experiences pain.

He also was targeted by some of the other prisoners, who apparently picked him out because of his education, the respect he got from other prisoners or simply because he was "weakest person to attack."

"I prayed to God that they'd send me back, the guards would send me back, to the old cell ? because in the old cell you had (the space) by yourself," he said.

Sacrificing 'for a better Libya'
On Aug. 24, people living around Abu Salim learned that the guards had fled as rebel forces advanced in Tripoli so they brought hammers and began breaking the locks to the prison's main gate. The prisoners did not believe they were about to be freed until people began breaking the locks to their section ? and then they were afraid for their safety even as they were getting out, Tabuni said.

They wanted to be released, "but you don't want to get killed" by any pro-Gadhafi forces that might still be around, he said.

After the cheering, Libyans wary but optimistic

Human Rights Watch officials say they don't know how many people were arrested over the six months of the uprising, "but certainly it was in the thousands," said Fred Abrahams, a special adviser for the organization, in an email to msnbc.com. Most were men, roughly between the age of 18 and 50, including some Libyan dual nationals and Americans, includingMatthew VanDyke, a filmmaker and writer from Baltimore who was held in solitary confinement for six months.

"We heard consistent and disturbing reports from former detainees about regular beatings, torture and, in the closing days, executions," Abrahams said. "In one case, 19 detainees suffocated to death in a metal shipping container. Some were held in the established prisons, such as Jdeida and Abu Salim in Tripoli, but many were held in makeshift facilities, frequently abandoned company grounds. None of the people we interviewed had had any form of judicial process, let alone access to a lawyer. Some were arrested for having used arms but many were arrested for having peacefully opposed their government."

Tabuni's 27-year-old daughter, Olaa Tabuni, who lives in California, said words couldn't describe her emotions during her father's detention, especially when prisoners were released and told reporters how they "were humiliated and tortured."

"After hearing the prisoners were released and not hearing from my father, I panicked and I was worried that something might have happened to him," she wrote to msnbc.com. "I couldn't function properly after that, I couldn't sleep or eat. I think those weeks were the most depressing days of my life. Now I exactly know how the families who lost oppressed loved ones in prisons feel."

Tabuni, whose ailing mother died last year, said he elected to remain in his homeland, working in the medical industry to try "to bring something useful to the country."

But now, he is spending his newfound freedom working as a human rights activist ? a mantle he first took up while living in the U.S. He is working on a civil society forum, a prisoner's advocacy group and a human rights organization. Last week, he recently helped collect money, food and medicine for the remaining few areas held by pro-Gadhafi forces.

He said he would stay in Libya "until I feel that I am no longer needed."

"People sacrificed themselves," he noted, citing the reports of tens of thousands of people who disappeared during the uprising. "Why did they do that? So they would have a better Libya."

Despite what happened to him in prison, and ongoing food, water and electricity shortages in Tabuni, said he has no regrets.

"The whole experience is worth it," he said. "The freedom for people ? that they can breathe freedom ? so it was worth all of the effort."
