Report: Orion test flight pushed back to 2014, manned flight until 2021
Even something as exhaustively planned as the test-flight of the Orion spacecraft isn't immune to a slipping timeline. It's reportedly been pushed back from next year to 2014 -- when we're expecting to see the capsule launch from Cape Canaveral, loop around the planet twice at 3,700 miles (the furthest any spacecraft has journeyed since the '70s) before splashing down in the Pacific. This unmanned test was designed to see if the vehicle's heat-shield, flight-software and parachutes all work before lives are risked on board. It's also signified a pushing back of the first launch from 2016 until 2021. This means there's nine more years before someone calls us up as a crew replacement -- at least that's how our dream goes.

PFT: Neighbor calls Cassel hero after house fire
Getty ImagesIt?s official.? In Saturday?s edition of the Cleveland Plain Dealer, ?reader representative? Ted Diadiun addressed at length the decision to remove long-time Browns writer Tony Grossi from the team?s beat.? Diadiun?s article is well-written, superficially persuasive, and apparently effective, given the number of emails we?ve received from folks who believe based on Diadiun?s article that the newspaper did the right thing.
But it doesn?t change our opinion that the Plain Dealer cowered to the Browns.? In fact, it strengthens it.
When scrutinizing an employment decision, inconsistencies in the reasons and rationalizations from the employer become extremely important.? The thinking is that, if the employer can?t tell a unified story in support of a supposedly legitimate decision, it?s possible that the employer is trying to conceal potentially illegitimate motives.? Circumstantial evidence also takes on a critical role, since the employer rarely will admit to ordering the Code Red.? Or, perhaps for these purposes, a Code Orange.
And that?s really the ultimate question.? Did the Browns order a Code Orange on Grossi?? Or, more accurately, did the Plain Dealer reassign Grossi because it believed the Browns wanted Grossi out?
Let?s consider the facts, the circumstances, and the inconsistencies.
First, the facts.? Grossi posted on his Twitter page a message that he had intended to keep private.? In the message, Grossi called Browns owner Randy Lerner a ?pathetic figure? and ?the most irrelevant billionaire in the world.?? (Of all the billionaires in the world, technically one of them must be the most irrelevant.)? Grossi immediately deleted the tweet once he realized his mistake.? By then, however, his words had been copied and repeated across the Internet, and it was impossible to unring the bell.
Grossi apologized publicly, the Plain Dealer apologized publicly, and Plain Dealer publisher Terrance C.Z. Egger sent a written apology to the Browns and to Lerner.
Though not addressed in Diadiun?s column, the Browns responded with silence.? Apart from declining to comment in response to inquiries from PFT, the Browns and Lerner refused to take calls from Grossi, and possibly from other officials of the Plain Dealer.? Indeed, Diadiun admits that ?[n]one of the editors involved talked with anyone connected with the team? before making the decision to reassign Grossi.
Diadiun omits reference to the key question of whether the Plain Dealer tried to have such discussions.
Second, the circumstances.? Most significantly, Diadiun admits that Egger personally met with Lerner and team president Mike Holmgren on Wednesday, after the decision was made to reassign Grossi.? The fact that a meeting occurred invites speculation that the Browns cared ? or at a minimum that the Plain Dealer believed the Browns cared ? about the manner in which this situation was handled.
Third, the inconsistencies.? On Thursday, Plain Dealer managing editor Thom Fladung told 92.3 The Fan in Cleveland that the ?determining factor? for the decision was the following standard:? ?Don?t do something that affects your value as a journalist or the value of your newspaper or affects the perception of your value and the perception of that newspaper?s value.?? Fladung also said that Grossi?s opinions would have been permissible if he had posted them not on his Twitter page, but in the pages of the Plain Dealer.? ?Let?s say Tony had written that Randy Lerner?s lack of involvement with the Browns and their resulting disappointing records over the years has made him irrelevant as an owner, that?s defensible,? Fladung said.? ?That?s absolutely defensible.?
But Diadiun?s item contains a contradictory quote from Plain Dealer editor Adam Simmons, who thinks that Grossi?s role as a beat writer precluded him from making the statements about Lerner in any context.? ?If it had been a columnist who wrote that, we might cringe, but that role is different,? Simmons said. ?They?re paid to offer up opinions, however prickly. But we?re not asking them to go out and cover a team in a fair and balanced and objective way, like we are with a reporter.?? (Presumably, Simmons also believes that a columnist could have offered those opinions on his Twitter page, since opinions are fair game for a columnist.)
Complicating matters is Diadiun?s attempt to reconcile the action against Grossi with his First Amendment rights.? Rather that relying on the simple ? and accurate ? notion that employees of a private, for-profit enterprise have no First Amendment rights, Diadiun draws a clumsy line between personal and professional social media.? ?Anyone who works at the paper has the right to say, write or Tweet anything they wish,? Diadiun writes.? ?But they do not have a corresponding right to say it in the newspaper or on the website or on their newspaper Twitter account.? If they do, the editors who are in charge of maintaining the credibility of the newspaper have the right to change their assignment.?
So Fladung says that Grossi could have said what he said in the paper, Simmons says that Grossi couldn?t have said what he said anywhere unless he was a columnist, and Diadiun says that Grossi could have said what he said on his own, personal Twitter page.? And no one says it?s impermissible for Grossi to secretly possess those views, even if those views (as Diadiun writes) undermine his credibility.? Under the newspaper?s view of journalistic ethics, it only becomes a problem when those views are disclosed ? which actually should make Grossi even more credible, since he has openly acknowledged his bias.
The end result is a stew of mixed messages, which invites speculation that the real reason for the move was to maintain a good relationship with the Browns.? Though there continues to be ? and likely never will be ? any evidence that the Browns told the Plain Dealer what the Browns wanted the Plain Dealer to do, some of the loudest and clearest messages can be sent through silence.
When Grossi or others from the Plain Dealer tried to call Lerner and/or Holmgren and they refused to speak, what should a reasonable person conclude?? Moreover, why would a meeting with Lerner and Holmgren even be needed if the Plain Dealer didn?t care about the team?s response to the situation?? If this decision was solely about journalistic standards and the integrity and credibility of Grossi?s coverage in the eyes of the audience given his personal views regarding Lerner, there was no reason to go to Berea and kiss rings and/or smooch butts.
That?s the fundamental disconnect.? The Plain Dealer wants us to believe it engaged in a textbook exercise in ethics while at the same time doing things like writing letters of apology to Lerner and publicly calling Grossi?s words about Lerner insulting and personally meeting with Lerner and Holmgren.
Though the Browns may not have intended to order a Code Orange, we believe that the Plain Dealer believed that it needed to remove Grossi from the beat in order to remain in the good graces of the Browns.? And we?d have far more (or, as the case may be, any) respect for this decision if the Plain Dealer would simply admit that which upon inspection of the facts, the circumstances, and the inconsistencies seems obvious.

AMES, Iowa (AP) ? Royce White has been so bad from the free throw line lately that his struggles have literally turned into nightmares.
A few hours after waking up from a dream in which he couldn't hit anything from the line, White sank the two biggest freebies of his career to give Iowa State a landmark win for coach Fred Hoiberg.
White had 18 points and nine rebounds as the Cyclones upset fifth-ranked Kansas 72-64 on Saturday, snapping the Jayhawks' winning streak at 10 games.
White, the versatile big man who entered shooting an abysmal 39 percent from the line in Big 12 games, hit a pair that rattled in to put Iowa State up 64-59 with 1:47 left.
Kansas then threw the ball away and Chris Babb drained a backbreaking 3 to give the Cyclones an eight-point lead with 55.6 seconds left.
"I woke up this morning dreaming about missing free throws. So I was in the gym this morning and shot free throws trying to get it right," White said. "Teammates keep encouraging me and telling me, 'You can make free throws.'"
Tyshawn Taylor led five players in double figures with 16 points and 10 assists for Kansas (17-4, 7-1 Big 12), which hadn't lost since Dec. 19 against Davidson.
Big 12 player of the year favorite Thomas Robinson had 13 points, but he committed five turnovers and the Jayhawks were outrebounded 36-23.
"I thought we got stops, but I didn't think we cleaned up. How many times did they miss a shot and the ball go off of us and us not secure or whatever?" Kansas coach Bill Self said. "Obviously, we didn't do a good last 3 minutes defensively at all."
Melvin Ejim had 15 points and Scott Christopherson added 14 for the Cyclones (15-6, 5-3), who had lost 13 straight to Kansas since their last victory in 2005. Iowa State students celebrated the program's biggest win in years ? and first over Kansas at home since 2004 ? by storming the floor.
"It was a great win for our program. But like I told our guys, you know, you've got to expect to win your home games," Hoiberg said. "I told the guys to enjoy it and get refocused."
This was Kansas' toughest true road test of the year so far ? and it ended with the Jayhawks' first true road loss of the season.
But Kansas caught the Cyclones napping to start the second half and took its biggest lead to that point, 45-39, thanks to an 11-0 run. Big man Anthony Booker brought Iowa State back, sinking a rare 3-pointer to put the Cyclones ahead 50-49 with 12:13 left.
Neither team could get much going over the next 6 minutes, but Tyrus McGee's three-point play gave Iowa State a 56-53 lead with just over 6 minutes left. Robinson then blew an open dunk and White hit two layups ? one a reverse he spun off the glass ? to make it 60-55 Iowa State with 3:42 left.
"This was our first true road game with a good crowd, a good atmosphere. So, we're going to be seeing that from now on," Taylor said. "Our emphasis this week in practice is just going to be taking care of the ball and just rebound and rebound. You can't lose on the boards like that."
Iowa State fed off the energy of its second sellout crowd of the year and jumped on the Jayhawks early.
Booker drilled a 3 and Babb followed with a steal and layup that put Iowa State ahead 19-11, prompting Self to call timeout.
Kansas finally took a 31-29 lead on an impressive scoop through traffic from Taylor with 3:31 left before the break. Iowa State rallied to grab the halftime advantage, 37-33, despite committing 13 turnovers in the first 20 minutes.
The Cyclones led in part because of their defense on Robinson. He was 1-of-6 shooting in the first half and traveled three times trying to free himself up for shots in the paint.
Jeff Withey, Elijah Johnson and Travis Releford each scored 10 points for Kansas.
"Just not playing my game. Speeding up the game and not taking my time. I'm just not playing the same right now," Robinson said.
Kansas certainly knew what Iowa State was capable of after the Cyclones threw a scare into the Jayhawks in Lawrence two weeks ago.
Iowa State led at halftime back on Jan. 14 and pushed its lead to as many as 12 points before Kansas stormed back for an 82-73 win. The Cyclones might have been able to pull off that upset had they shot better than 2 of 15 from 3-point range in the second half.
Iowa State didn't let the opportunity pass by this time around ? and it now has a marquee win that will look great on its resume come March.
"It definitely feels good to beat them. We felt like we should have won the first time," said White, who finished 6 of 11 from the line. "We knew that it was basically a must-win for us."

Should YouTube Ban Videos of the Adorable but Endangered Slow Loris?
Like hundreds of thousands of other people, my first encounter with a slow loris occurred online when I watched the now-famous 57-second video of one of these adorable primates being tickled and throwing up its arms in apparent glee. That video has been viewed more than nine million times since it was posted in June 2009.
But some conservationists argue that videos like this create a false impression of the slow loris in viewers? minds, and in the process fuel the illegal pet trade that brutally mangles the tiny creatures and puts them at risk of extinction in the wild.
On January 25 the BBC aired a documentary called Jungle Gremlins of Java (viewable here if you live in the U.K.) that examined the illegal pet trade in Jakarta, Indonesia, where slow lorises are available in Indonesian markets for as little as $20. They await their fate in tiny cages after having their front teeth and venomous elbow patches painfully clipped off with pliers, nail clippers or wire cutters. (Lorises are the world?s only venomous primates.) Many of the animals die shortly after being sold, as the removal of their teeth can hamper their ability to eat.
The documentary?s host, Oxford Brookes University anthropologist Anna Nekaris, told BBC News that lorises rescued from the pet trade can never be reintroduced into the wild because they have no teeth and can?t fend for themselves.
There are five slow loris species, along with six species of slender lorises. The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) limits the sale of all slender lorises (from the genus Loris) and bans trade in two of the three loris species from the genus Nycticebus (the Bengal slow loris, N. bengalensis, and the pygmy slow loris, N. pygmaeus). The International Union for Conservation of Nature Red List of Threatened Species only lists two species as ?endangered,? but classifies the rest as ?vulnerable to extinction? with declining populations.
According to the International Animal Rescue Web site, ?Thousands of slow lorises are poached from the wild and illegally sold as pets or for use in traditional medicine. Domestic and international trade takes place in various ways, from open selling of slow lorises on roadsides to smuggling them in poorly ventilated, overcrowded cages. In Indonesia slow lorises are sold on the street or in traditional animal markets as well as in city malls. Although both Indonesian and international laws ban the trade in slow lorises, the illegal wildlife trade is flourishing.?
In response to the documentary, the organization International Animal Rescue Indonesia has posted an online petition asking YouTube to remove clips of captive lorises.
?Videos portraying the slow loris as a cute, furry pet increase the demand for slow lorises, fueling the trade,? the petition reads. ?Slow loris behaviors, which are caused by stress or fear, are misinterpreted as funny. YouTube has many slow loris videos on the Web site which show the slow loris as a pet, some of which have been watched millions of times. Despite requests to take these videos down, YouTube refuses to see the animal suffering in the slow loris clips.?
Nekaris has been asking YouTube to remove the slow loris videos for the last few years. ?Lorises are?traded openly in Indonesian markets and the YouTube clips only increase the demand,? she told The Independent in March 2011. ?Tackling this trade should be an urgent priority for wildlife-enforcement agencies. The penalty should be greater than simply confiscation of the animal.? YouTube responded, saying that their community guidelines prohibit animal abuse, and videos that are found to violate that guideline are removed ?usually in under an hour.?
Nekaris told the conservation news site Mongabay.com in 2009 that lorises appear docile in these videos because ?it is part of their defense mechanism?to be still and silent? when held and otherwise threatened. That?s also one of the reasons why it is so easy for poachers to grab the animals from their wild habitats. ?The infants are particularly defenseless and easy to catch,? she said. ?Any hunter going into the forest will just grab a loris if he sees it.?
The pet trade isn?t the only reason why lorises are endangered. As I wrote in 2010, they are also used in traditional Asian medicine to ?treat? conditions such as leprosy, heal broken bones and ward off the ?evil eye.? Of course, none of these purported medical benefits have any grounding in science. All lorises are also threatened by habitat loss.
So what do you think? Should YouTube remove these videos because they harm wildlife, similar to the reasons why eBay banned the sale of ivory, or should they be allowed to stand on the grounds of freedom of expression?

'Dance' choreographer gets 10 years for rape and assault (Reuters)
LOS ANGELES, Jan 27 (TheWrap.com) ? Alex Da Silva, a former choreographer for Fox reality competition "So You Think You Can Dance," was sentenced to 10 years in prison on Friday for raping a former dance student and assaulting another, TMZ reports.
Da Silva, 43, was arrested in 2009 and charged with multiple counts of raping and sexually assaulting four women, all of whom had been his students.
A jury found him guilty on one count of rape and one count of assault with intent to commit rape. It deadlocked on other charges, which were dismissed.
Da Silva had appeared on the first four seasons of the series.
This isn't the first scandal to be associated with "So You Think You Can Dance"; in August 2011, Shane Sparks, who had also appeared as a choreographer on the show, was charged with eight counts of felony child molestation in 2009. He pleaded no contest to one count of unlawful intercourse with a minor under the age of 16 in August 2011, and received 270 days in jail.

David Otunga wins pro bono legal case
David Otunga, who serves as the legal counsel to EVP of Talent Relations and Interim Raw GM John Laurinaitis, took to the courts on Thursday in a pro bono case against the New York State Department of Labor.?Otunga had been hired to represent a man who claimed he had been wrongfully terminated from his job and, as a result, was receiving no unemployment benefits.?After hearing arguments from both sides, the judge sided with the legal eagle WWE Superstar.?
"I smoked the witness during cross examination," Otunga told TMZ after the case had concluded.?His client subsequently won the appeal, and will now receive the appropriate benefits.?
While it may seem surprising for a WWE Superstar to accomplish such a feat, it's just business as usual for Otunga. The dapper Superstar is no stranger to balancing two workloads -- not to mention winning cases. "I actually worked as a full time trial lawyer in Boston while in my third year at Harvard Law School," Otunga told WWE.com. "Most people couldn?t have handled trying to graduate from the most prestigious law school in the world while trying cases full time, but I?m obviously not most people."
Otunga says he takes the pro bono cases simply to keep his skills up, and not necessarily because he needs the payday. "I don?t have time for a full caseload because I?m a globally recognizable WWE Superstar and Official Legal Counsel to Executive Vice President of Talent Relations and Interim Raw General Manager, Mr. John Laurinaitis," Otunga tells us, "But I like to stay sharp."
Adding to the accomplishment is that Otunga is undefeated in court cases, proving that if nothing else, Mr. Laurinaitis chose well in appointing his counsel and will be well-equipped when Chief Operating Officer Triple H evaluates Laurinaitis' job performance next Monday on Raw SuperShow.
"I?ve tried twenty cases and I?ve won them all," Otunga told WWE.com. "I have a perfect record. What else would you expect from someone like me?"
So if Otunga gives an especially emphatic slurp of his coffee at the Royal Rumble this Sunday, know he's got a pretty good reason.

WASHINGTON ? A new Justice Department fraud-fighting unit will bring together 55 prosecutors and federal and state investigators focusing on one of the contributing factors to the financial crisis ? the collapse of residential mortgage-backed securities.
Attorney General Eric Holder and other officials will unveil details about the new unit Friday. President Barack Obama disclosed the plan to create the unit in his State of the Union address Tuesday night.
New York Attorney General Eric Schneiderman, one of the co-chairs of the initiative, said it is an effort to pull together state and federal probes into the bubble of mortgage-backed securities that led to the market crash.

Thursday, January 26, 2012In one of the largest-ever analyses of lifetime risks for cardiovascular disease (CVD), researchers have found that middle-aged adults who have one or more elevated traditional risk factors for CVD, such as high blood pressure, have a substantially greater chance of having a major CVD event, such as heart attack or stroke, during their remaining lifetime than people with optimal levels of risk factors. This National Institutes of Health-supported study used health data from 257,384 people and was the first to look simultaneously at multiple risk factors for CVD across age, sex, race, and birth generation.
The paper will be published in the January 26 issue of the New England Journal of Medicine.
"This paper adds to the substantial body of evidence that modifiable cardiovascular disease risk factors in healthy men and women heavily influence the likelihood of developing cardiovascular disease later in life, regardless of their backgrounds," said Susan B. Shurin, M.D., acting director of the NIH's National Heart, Lung, and Blood Institute.
"Prevention of cardiovascular disease is a lifetime opportunity for and a responsibility of individuals, families, communities, and the health care system. This paper reinforces that cardiovascular disease can be prevented and controlled throughout the course of an adult's lifetime," she added.
As part of the Cardiovascular Lifetime Risk Pooling Project, investigators analyzed 50 years of data from 18 existing cohort, or population-based, studies in the United States. The investigators pooled the data from the 18 cohorts and measured traditional CVD risk factors ? including high blood pressure, high cholesterol levels, diabetes, and smoking status ? in men and women from both black and white populations at ages 45, 55, 65, and 75 years.
Men who were 55 years old with at least two major risk factors were six times as likely to die from CVD by age 80 as were men with none or one CVD risk factor (29.6 percent vs. 4.7 percent). Women with at least two major risk factors were three times as likely to die from CVD as were women with no or one CVD risk factor (20.5 percent vs. 6.4 percent).
When all CVD events ? fatal and non-fatal ? were considered, the results were even more striking. Forty-five-year-old men with two or more risk factors had a 49.5 percent chance of having a major CVD event through age 80, while 45-year-old women had a 30.7 percent chance. On the other hand, men with optimal risk factor levels only had a 1.4 percent chance of having a major CVD event, while women had a 4.1 percent chance of having a major CVD event through age 80.
The results from each individual study were consistent with one another and with those of the pooled group, and showed that traditional risk factors predicted a person's long-term development of CVD more than age. All of the risk factors appeared to carry the same levels of risk as they did 20, 30, or 40 years ago. While black Americans had a higher prevalence of CVD risk factors than white Americans, their lifetime risks were similar when their risk factor profiles were similar.
"In general, previous studies have only looked at CVD risk factors across one specific age or gender in white populations," said Donald M. Lloyd-Jones, M.D., principal investigator of the study and an associate professor and chair of the Department of Preventive Medicine at Northwestern University Feinberg School of Medicine in Chicago. "We analyzed an enormous pool of available data, which allowed for a more precise estimate of lifetime CVD risks across the age, sex, race, and risk factor spectrum."
Lloyd-Jones added, "These data have important implications for prevention. We need to get more serious about promoting healthy lifestyles in children and young adults, since even mild elevations in risk factors by middle age seem to have profound effects on the remaining lifetime risks for CVD."
The NHLBI supported several of the cohort studies involved, including the Atherosclerosis Risk in Communities Study, Cardiovascular Heart Study, Framingham Heart Study, Framingham Offspring Study, Honolulu Heart Program, Puerto Rico Heart Health Program, and Women's Health Initiative.
"This paper illustrates the power of pooling data from epidemiological studies," said Michael Lauer, M.D., director of the NHLBI's Division of Cardiovascular Sciences. "Because of the U.S. government's investments in these studies, it was possible for the investigators to gather and analyze data on over a quarter of a million people, which could lead to substantial public health and clinical practice implications."
"It is important for adults to know their blood pressure and cholesterol numbers and whether they are at risk for diabetes and also to understand the different approaches they can take to prevent or control their risks for CVD. As American Heart Month approaches in February, this paper underscores the importance of raising awareness of heart disease and coronary heart disease ? the most common type of heart disease and the number one killer of both men and women in the United States," said Lloyd-Jones and Shurin.
In an effort to help people reduce their risks of cardiovascular disease, the Centers for Disease Control and Prevention and the Centers for Medicare and Medicaid Services recently launched the Million Hearts Campaign, a national initiative to prevent 1 million heart attacks and strokes over the next five years.
Also, in December 2010, in an effort to promote healthy behaviors and prevent diseases, including cardiovascular disease, the U.S. Department of Health and Human Services launched Healthy People 2020. Healthy People 2020 and its specific, measurable health objectives represent the nation's disease prevention and health promotion goals for the coming decade.

Drug Approved for Advanced Kidney Cancer (HealthDay)
FRIDAY, Jan. 27 (HealthDay News) -- Inlyta (axitinib) has been approved by the U.S. Food and Drug Administration to treat advanced renal cell carcinoma in people who haven't responded to another drug.
Renal cell carcinoma is a form of kidney cancer that begins in tissue that lines the kidney's small tubes. Inlyta blocks proteins that help fuel tumor growth in this area, the FDA said in a news release.
Six medications had been sanctioned previously for advanced kidney cancer, the agency said.
In a study of 723 people with the advanced form of kidney cancer, the most common side effects of Inlyta included diarrhea, high blood pressure, fatigue, loss of appetite, nausea, loss of voice, weight loss, weakness and constipation.
Among some patients, Inlyta also caused significant bleeding, which in some cases proved fatal. The FDA also warned that people with high blood pressure should make sure the problem is well controlled before taking the twice-daily drug.
People with untreated brain tumors or gastrointestinal bleeding should not take Inlyta, the FDA said.
The drug is marketed by Pfizer.

TV ratings: Fox wins night with "Idol" (Reuters)
LOS ANGELES (TheWrap.com) ? Fox scored a decisive win Wednesday night on the strength of "American Idol" and a preview of the new Kiefer Sutherland drama "Touch," while NBC's new comedy "Are You There Chelsea" dropped significantly to hit a ratings low, according to preliminary numbers.
"Idol," airing at 8 p.m., was down slightly from last week but was easily the night's top-rated and most-watched show of the night, drawing a 6.4 rating/18 share in the adults 18-49 demographic and 19.5 million total viewers. A preview of "Touch" the following hour posted a 3.9/10 in the demographic -- the second-highest drama debut this season, behind ABC's "Once Upon a Time" -- and 11.8 million total viewers. ("Touch" officially premieres March 19.) Combined, "Idol" and "Touch" gave Fox an average 5.2/14 in the demographic and an average 15.6 million total viewers.
On NBC, "Whitney" at 8 p.m. dipped to 1.4/4 in the demographic and 4.4 million total viewers, while "Are You There Chelsea," which premiered to so-so numbers earlier this month, had a 1.4/4 in the demographic and 3.9 million total viewers. It was down 18 percent in the ratings from last week. "Law & Order: SVU" repeats filled out the evening.
Following a "Criminal Minds" repeat at 8 p.m., CBS ran a new "Criminal Minds" at 9 p.m., which was up 13 percent versus last week for a 3.6/9 in the demographic and 13.6 million total viewers. "CSI" the following hour jumped 18 percent over last week, taking a 3.3/9 in the demographic and 14 million total viewers.

FACT CHECK: Obama pushes plans that flopped before (AP)
WASHINGTON ? It was a wish list, not a to-do list.
President Barack Obama laid out an array of plans in his State of the Union speech as if his hands weren't so tied by political realities. There can be little more than wishful thinking behind his call to end oil industry subsidies ? something he could not get through a Democratic Congress, much less today's divided Congress, much less in this election year.
And there was more recycling, in an even more forbidding climate than when the ideas were new: He pushed for an immigration overhaul that he couldn't get past Democrats, permanent college tuition tax credits that he asked for a year ago, and familiar discouragements for companies that move overseas.
A look at Obama's rhetoric Tuesday night and how it fits with the facts and political circumstances:
OBAMA: "We have subsidized oil companies for a century. That's long enough. It's time to end the taxpayer giveaways to an industry that's rarely been more profitable, and double-down on a clean energy industry that's never been more promising."
THE FACTS: This is at least Obama's third run at stripping subsidies from the oil industry. Back when fellow Democrats formed the House and Senate majorities, he sought $36.5 billion in tax increases on oil and gas companies over the next decade, but Congress largely ignored the request. He called again to end such tax breaks in last year's State of the Union speech. And he's now doing it again, despite facing a wall of opposition from Republicans who want to spur domestic oil and gas production and oppose tax increases generally.

OBAMA: "Our health care law relies on a reformed private market, not a government program."
THE FACTS: That's only half true. About half of the more than 30 million uninsured Americans expected to gain coverage through the health care law will be enrolled in a government program. Medicaid, the federal-state program for low-income people, will be expanded starting in 2014 to cover childless adults living near the poverty line.
The other half will be enrolled in private health plans through new state-based insurance markets. But many of them will be receiving federal subsidies to make their premiums more affordable. And that's a government program, too.
Starting in 2014 most Americans will be required to carry health coverage, either through an employer, by buying their own plan, or through a government program.

OBAMA, asking Congress to pay for construction projects: "Take the money we're no longer spending at war, use half of it to pay down our debt, and use the rest to do some nation-building right here at home."
THE FACTS: The idea of taking war "savings" to pay for other programs is budgetary sleight of hand. For one thing, the wars in Iraq and Afghanistan have been largely financed through borrowing, so stopping the wars doesn't create a pool of ready cash, just less debt. And the savings appear to be based at least in part on inflated war spending estimates for future years.

OBAMA: "Tonight, I want to speak about how we move forward, and lay out a blueprint for an economy that's built to last - an economy built on American manufacturing, American energy, skills for American workers, and a renewal of American values."
THE FACTS: Economists do see manufacturing growth as a necessary component of any U.S. recovery. U.S. manufacturing output climbed 0.9 percent in December, the biggest gain since December 2010. Yet Obama's apparent vision of a nation once again propelled by manufacturing ? a vision shared by many Republicans ? may already have slipped into the past.
Over generations, the economy has become ever more driven by services; not since 1975 has the U.S. had a surplus in merchandise trade, which covers trade in goods, including manufactured and farm goods. About 90 percent of American workers are employed in the service sector, a profound shift in the nature of the workforce over many decades.
The overall trade deficit through the first 11 months of 2011 ran at an annual rate of nearly $600 billion, up almost 12 percent from the year before.

OBAMA: "The Taliban's momentum has been broken, and some troops in Afghanistan have begun to come home."
THE FACTS: Obama is more sanguine about progress in Afghanistan than his own intelligence apparatus. The latest National Intelligence Estimate on Afghanistan warns that the Taliban will grow stronger, using fledgling talks with the U.S. to gain credibility and stall until U.S. troops leave, while continuing to fight for more territory. The classified assessment, described to The Associated Press by officials who have seen it, says the Afghan government hasn't been able to establish credibility with its people, and predicts the Taliban and warlords will largely control the countryside.

OBAMA: "On the day I took office, our auto industry was on the verge of collapse. Some even said we should let it die. With a million jobs at stake, I refused to let that happen. In exchange for help, we demanded responsibility. We got workers and automakers to settle their differences. We got the industry to retool and restructure. Today, General Motors is back on top as the world's number one automaker. Chrysler has grown faster in the U.S. than any major car company. Ford is investing billions in U.S. plants and factories. And together, the entire industry added nearly 160,000 jobs."
THE FACTS: He left out some key details. The bailout of General Motors and Chrysler began under Republican President George W. Bush. Obama picked up the ball, earmarked more money, and finished the job. But Ford, which Obama mentions as well, never asked for a federal bailout and never got one.

OBAMA: "We can also spur energy innovation with new incentives. The differences in this chamber may be too deep right now to pass a comprehensive plan to fight climate change. But there's no reason why Congress shouldn't at least set a clean energy standard that creates a market for innovation."
THE FACTS: With this statement, Obama was renewing a call he made last year to require 80 percent of the nation's electricity to come from clean energy sources by 2035, including nuclear, natural gas and so-called clean coal. He did not put that percentage in his speech but White House background papers show that it remains his goal.
But this Congress has yet to introduce a bill to make that goal a reality, and while legislation may be introduced this year, it is unlikely to become law with a Republican-controlled House that loathes mandates.

OBAMA: "Right now, because of loopholes and shelters in the tax code, a quarter of all millionaires pay lower tax rates than millions of middle-class households."
THE FACTS: It's true that a minority of millionaires pay a lower tax rate than some lower-income people. On average, though, wealthy people pay taxes at a much higher rate than middle-income taxpayers.
Obama's claim comes from a Congressional Research Service report that compared federal taxes paid by people making less than $100,000 with those paid by people making more than $1 million. About 10 percent of families with incomes under $100,000 paid more than 26.5 percent in federal income, payroll and corporate taxes. And about a quarter of millionaire taxpayers paid a rate lower than that.

OBAMA: "We can't bring back every job that's left our shores.... Tonight, my message to business leaders is simple: Ask yourselves what you can do to bring jobs back to your country, and your country will do everything we can to help you succeed."
FACT CHECK: Many of the jobs U.S. companies have created overseas won't return because they were never in the United States in the first place.
As Obama said in his speech, U.S. workers have become more productive and labor costs have fallen.
But there are powerful forces pushing the other way: Many of the overseas jobs in U.S. companies weren't transferred from the U.S. They were created in fast-growing markets in Latin America, Asia and elsewhere to serve customers in those markets. Companies in the Standard & Poor's 500 index now earn more than half of their revenue from overseas.
That has fueled more job creation abroad. U.S. multinationals cut more than 800,000 jobs in the United States from 2000 to 2009, according the Commerce Department. They added 2.9 million overseas in the same period.

OBAMA: "Anyone who tells you that America is in decline or that our influence has waned doesn't know what they're talking about ... That's not how people feel from Tokyo to Berlin; from Cape Town to Rio; where opinions of America are higher than they've been in years."
THE FACTS: Obama left out Arab and Muslim nations, where popular opinion of the U.S. appears to have gone downhill or remained unchanged after the spring 2011 reformist uprisings in the Middle East. A Pew Research Center survey in May found that in predominantly Muslim countries such as Turkey, Jordan and Pakistan, views of the U.S. were worse than a year earlier. In Pakistan, a major recipient of U.S. foreign aid that went unmentioned in Obama's speech, just 11 percent of respondents said they held a positive view of the United States.

STATE COLLEGE, Pa. (AP) ? Joe Paterno's family said Monday the legendary football coach will get a two-day viewing and a public memorial this week on the Penn State campus, two months after the university summarily fired him over the phone.
The family gave no details on who might be invited or asked to speak at the memorial Thursday at the basketball arena, which can hold 16,000 people. Penn State spokeswoman Lisa Powers said the specifics were still being worked out with the Paternos.
But many alumni and students say Paterno was treated shabbily by the Board of Trustees in November, and trustees and other members of the administration might not be made to feel welcome at the memorial for the 85-year-old coach, who died Sunday of lung cancer.
"I don't think it's going to be heavily laden with administration and trustees," said trustee Linda Strumpf, who lives in New York and will not attend. "This is something the family is putting together and not the university. I don't think the university wants to be in a position to tell them what a memorial service looks like."
But trustee Al Clemens said he will be there to honor a man he described as a good friend.
"This is really a family thing, and so we're just going to go as individuals," Clemens said. "Joe's a great guy. No matter was the situation was in the last two months, it doesn't take away from what he's done through history for so many people. He's just been tremendous."
The viewing will be held Tuesday and Wednesday at a campus spiritual center, followed by a private funeral Wednesday afternoon. The public memorial will be at the Jordan Center and is expected to draw thousands.
Michael Day, a 1973 Penn State graduate from Hagerstown, Md., whose father taught there and whose four children all have Penn State degrees, said the trustees were wrong to fire Paterno and he believes they will ultimately be replaced. He said he hopes they don't attend.
"I think the Penn State community is separate from the Penn State Board of Trustees," he said. "The Board of Trustees has separated itself from the Penn State community, and the Penn State community loves Joe Paterno and always will. So it's appropriate for the Penn State community to honor Joe Paterno in this service."
Paterno was fired Nov. 9 after he was criticized over his handling of child sex-abuse allegations leveled against former assistant Jerry Sandusky in 2002. Pennsylvania's state police commissioner said that in not going to the police, Paterno may have met his legal duty but not his moral one.
Bitterness over Paterno's removal has turned up in many forms, from online postings to a note placed next to Paterno's statue at the football stadium blaming the trustees for his death. A newspaper headline that read "FIRED" was crossed out and made to read, "Killed by Trustees." Lanny Davis, lawyer for the board, said threats have been made against the trustees.
Janice Hume, a journalism professor at the University of Georgia, said that staging an appropriate memorial creates a dilemma similar to the one faced by Paterno's obituary writers: how to address the scandal without letting it negate his entire career.
"I think it's probably very difficult to strike the right balance," she said.
Clemens said the board will later consider more lasting tributes to Paterno, including scholarships in his name. Because of his generosity to the school, his family name is already on the library and a spiritual center.
There has also been a movement over the past few years to change the name of Beaver Stadium, the football team's home field, to Joe Paterno Field at Beaver Stadium, and on Monday the man behind it, Warren W. Armstrong, a 1960 graduate and retired Allentown advertising executive, said he would renew his efforts. Some are suggesting renaming the street leading to the stadium Paterno Way.
A family spokesman said the Paternos' focus this week is on the viewing and funeral plans and they do want to weigh in on any ideas for a permanent memorial right now. But "I would say the family would welcome a conversation on that," Dan McGinn said.
